Legal Services Support Program for Intellectual Property Rights Application Guidelines

1. Time of Application 


1.1 Applications shall be accepted throughout the year.


2. Methods and Amounts of Support


2.1 A lump sum subsidy of  RMB 1 million will be offered to any national or international first-class organization established in the Shenzhen Park and dedicated to providing intellectual property-related arbitration, mediation, litigation and other legal services.


3. Conditions for Application 


3.1 National or international first-class organizations or institutions duly registered in the Shenzhen Park as independent legal persons to provide intellectual property-related arbitration, mediation, litigation or other legal services shall, at the minimum, meet one of the following conditions to apply for the support: 


(a) They are either legal firms (including their branches) incorporated in the Shenzhen Park upon the approval of judicial administrative departments or representative offices of foreign, Hong Kong or Macao legal firms located in Guangdong Province; 


(b) They are either branches of international legal service organizations incorporated in the Shenzhen Park or other legal organizations/institutions conducive to the internationalization of the legal service industry in the Shenzhen Park; or


(c) They are public notary, judicial expertise, law ascertainment, arbitration or protection organizations/institutions incorporated in the Shenzhen Park upon the examination, approval and registration of competent administrative departments in charge of civil or judicial affairs.  


3.2 They shall have leased office space in the Shenzhen Park and have come into operation. 


3.3 They shall have standardized operations and sound management systems, have paid contributions to the social security schemes according to law, and be free of  legal or regulatory violations.


3.4 Should the applicants or their legal representatives violate research integrity, they shall be entered on to the Shenzhen Park’s list of research integrity exceptions and subject to relevant restrictions in applying for fiscal support.



4. Application Materials 

(the following materials except originals need to be affixed with official seals)


4.1 Application Form for the Legal Services Support Program for Intellectual Property Rights.


4.2 Originals and copies of the evidentiary materials for the status of first-class domestic or foreign organizations/institutions.


4.3 Evidentiary materials for the lease or acquisition of office space. 


4.4 Letters of commitment to not move out of the Shenzhen Park within five (5) years.



5. Application and Approval Procedures


5.1 Application: All eligible applicants can apply to the Management Authority by submitting the required application materials.


5.2 Acceptance: The acceptance personnel shall be responsible to verify the application materials and file those that are complete, standardized and in line with statutory forms. Applications that do not comply with requirements will be returned for corrections and may be filed later after they are corrected. Those ineligible shall be rejected.


5.3 Examination: The Management Authority shall preliminarily examine the applications through internal meeting. Should an application be found incomplete or incorrect, the applicant shall be required to make additions or corrections.


5.4 Approval: The Management Authority shall be responsible to draft a proposed support plan and then refer the plan to the Working Meeting of the Shenzhen Steering Group Office for Development of Shenzhen-Hong Kong Science and Technology Innovation Cooperation Zone for deliberation and approval.


5.5 Finalization: Projects approved shall be notified to the public in accordance with existing provisions. Regarding those without objections or with objections that have been resolved during the period of notification, the support funds shall be disbursed as required.



6. Others

6.1 These guidelines shall be effective as of  December 11, 2021, for a period of one (1) year.
